1Acceptance of Terms
By accessing or using the NURDE application ("the App") or the associated landing page (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and LFJC LLC, a company organized under the laws of the State of California. References to "we," "us," or "our" refer to LFJC LLC.
You represent that, where applicable, you are a licensed or otherwise credentialed healthcare professional — or a student in a healthcare-related program of study — using the App within the scope of your professional capacity.
2Description of Service
NURDE is a clinical reference application designed and built by a single developer — a critical care bedside nurse — for use by licensed healthcare professionals, including registered nurses, advanced practice nurses, and other credentialed clinical staff. The App provides access to:
- Organized reference materials grouped by specialty and clinical topic
- General pharmacology information and infusion rate reference tables
- Educational frameworks and study tools for nursing practice
All content within the App is intended exclusively for educational and reference purposes. The App is not a substitute for professional clinical judgment, formal medical education, or institutional policy and procedure.
Nothing in the App constitutes medical advice. Content should never be interpreted as directing clinical care for a specific patient.
3Not a Medical Device
NURDE is explicitly not a medical device as defined by the U.S. Food and Drug Administration (FDA) or any equivalent regulatory body in any jurisdiction.
- The App has not been reviewed, cleared, or approved by the FDA or any other regulatory authority.
- The App does not accept patient-identifying information. Its calculators and scoring tools perform standard, published formula computations (for example, weight-based infusion rates and validated clinical scoring scales) for educational reference only; all outputs must be independently verified against institutional protocols and provider orders before any clinical use.
- The App does not generate patient-specific diagnoses, treatment plans, medication orders, or clinical decisions.
- The App provides general reference information only, with no knowledge of any individual patient's condition.
Any use of the App in connection with direct patient care is undertaken solely at the discretion and professional responsibility of the individual clinician.
4Scope of Practice and Professional Responsibility
The App is intended to support, not replace, the professional judgment of licensed healthcare providers. By using the App, you acknowledge and agree that:
- You are solely responsible for verifying that any information accessed through the App is appropriate, current, and applicable to the specific clinical situation you encounter.
- You must comply with your institution's policies, protocols, and procedures, your applicable scope of practice under your licensure, and all state, federal, and professional regulations governing your practice.
- Clinical guidelines, drug dosing information, and protocols change frequently. Content within the App may not reflect the most current standards of care, recent guideline updates, or facility-specific adaptations.
- LFJC LLC is not responsible for any clinical decisions, actions, or outcomes arising from your use of or reliance on the App.
- No content in the App authorizes, directs, or recommends any clinical action. All clinical actions must be ordered by a licensed and credentialed provider with prescriptive authority and executed in accordance with your institution's policies and your individual scope of practice.
- Your professional license is your responsibility. It is your obligation — not the App's — to practice within your authorized scope, follow your employer's policies, and apply independent clinical judgment at all times.
5Intellectual Property
All content within the App and on the landing page — including but not limited to clinical protocol text, organizational structure, design, graphics, and written descriptions — is the original work of LFJC LLC and is protected by applicable copyright, trademark, and other intellectual property laws.
- You may not reproduce, distribute, modify, publicly display, or create derivative works from any content within the App without the express prior written permission of LFJC LLC.
- Personal, non-commercial use for individual clinical reference purposes is permitted within the scope of normal App use.
- The name "NURDE" and the associated logo and branding are proprietary to LFJC LLC.
To request permission for any use beyond personal clinical reference, contact admin@lfjcllc.com.
6Prohibition on Entering Patient Information (No PHI)
The App is not designed, built, or certified to handle Protected Health Information as defined under the Health Insurance Portability and Accountability Act (HIPAA). Specifically:
- Do not enter patient names, dates of birth, medical record numbers, or any other patient identifiers.
- Do not enter clinical findings, diagnoses, or notes that could be linked to an identifiable individual.
- The notes feature is provided for general clinical annotations only (e.g., personal memory aids, unit-specific variation reminders) and is not intended for patient-specific documentation.
LFJC LLC is not a HIPAA-covered entity or business associate. LFJC LLC assumes no liability and bears no responsibility for any consequences arising from a user's decision to enter PHI or patient-identifying information into the App, in violation of these Terms.
7Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LFJC LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that the clinical content is accurate, complete, current, or suitable for any specific clinical purpose.
- Any warranty that the App will be uninterrupted, error-free, or free of defects.
- Any warranty regarding the suitability of any protocol, dosing guide, or reference content for any particular patient or clinical situation.
Clinical practice guidelines, drug dosing recommendations, and standards of care evolve continuously. Content within the App may not reflect the most current published guidelines, FDA label updates, or institutional adaptations. You are responsible for independently verifying the currency and applicability of any reference information before acting on it.
8Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LFJC LLC, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY:
- Patient harm, clinical errors, adverse outcomes, or medical malpractice arising from use of or reliance on the App.
- Indirect, incidental, special, consequential, punitive, or exemplary damages.
- Loss of profits, data, goodwill, or other intangible losses.
- Damages resulting from the accuracy, completeness, or currency of any clinical reference content.
This limitation applies regardless of the legal theory asserted (contract, tort, strict liability, or otherwise) and even if LFJC LLC has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
9Indemnification
You agree to indemnify, defend, and hold harmless LFJC LLC and its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way related to:
- Your use of or access to the Service.
- Your violation of these Terms.
- Your violation of any applicable law, regulation, or professional standard.
- Any clinical decision made using information from the App.
- Your entry of PHI or patient-identifying information into the App.
10Professional License Protection
The content in this App reflects general educational reference material and does not constitute the practice of nursing, medicine, pharmacy, or any other licensed healthcare profession.
Nothing in this App is intended to conflict with, supersede, or substitute for any applicable nursing practice act, regulatory body rules, or federal or local law governing nursing practice in your jurisdiction.
To protect both your license and your patients:
- Never act on App content without independent verification. Always cross-reference against your institution's current policies, the patient's chart, current clinical guidelines, and your own clinical assessment.
- Scope of practice is yours to own. Nothing in this App expands, modifies, or defines your scope of practice. Your authorized scope is determined solely by the nursing practice act, regulatory body, licensure status, employer policies, and individual credentials applicable in your jurisdiction — not by this App. For users practicing in California, this includes the California Nursing Practice Act (B&P Code §2700–2837) as enforced by the BRN.
- Medication administration requires a valid order. Drug reference information in this App is for educational purposes only. No content in this App constitutes a medication order, a prescriptive recommendation, or authorization to administer any drug. All medication administration must be carried out pursuant to a lawful order from a licensed prescriber, in accordance with your applicable regulatory standards and your facility's medication administration policies.
- Expanded practice authorizations still require proper institutional approval. If your practice includes expanded or delegated nursing actions — such as standardized procedures, protocols, or standing orders — those must be formally authorized by your institution and permitted under your jurisdiction's applicable nursing practice regulations. This App does not constitute such an authorization.
- If in doubt, do not act. Use your institution's chain of command, consult a supervising physician or charge nurse, and follow your facility's policies before taking any action in an uncertain clinical situation. This reflects the universal standard of safe, competent nursing practice expected by licensing bodies worldwide.
- This App is not a substitute for formal clinical education, orientation, or competency validation. New nurses and nurses practicing in unfamiliar clinical areas should seek appropriate supervision and mentorship as required by their applicable regulatory and employer standards.
LFJC LLC expressly disclaims any responsibility for disciplinary action by the California BRN or any other licensing authority, licensure consequences, or adverse professional outcomes arising from a user's misuse of, over-reliance on, or misinterpretation of any content within this App.
11Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to personal jurisdiction in those courts.
12Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Changes are effective upon posting.
Your continued access to or use of the Service after any changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Service.
13Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and LFJC LLC with respect to the Service and supersede all prior agreements, communications, and understandings, whether written or oral.
